DENVER (AP) -- Secretary of State Scott Gessler says he is suing Denver for automatically mailing ballots for an upcoming municipal election to inactive voters.
Gessler called a news conference on Wednesday to provide details of the lawsuit. Gessler says elections law prohibits the city from mailing ballots to voters who didn't vote last year and didn't
respond to requests to activate their registrations.
Denver Clerk and Recorder Debra Johnson says the city is proceeding with its ballot plan to make it easier for eligible people to vote.
Pueblo Clerk and Recorder Gilbert Ortiz told the Pueblo Chieftain Tuesday that he submitted his
election plan months ago to the Colorado secretary of state's office and it was approved despite including inactive voters in the mailing.
