Lakewood, Colo. (AP) A woman who prosecutors said gave birth in a toilet and allowed her baby to drown pleaded guilty to child abuse resulting in serious bodily injury following a mistrial.
A jury Wednesday was unable to reach a unanimous verdict against 31-year-old Cheri Marie Kostur. A pathologist had testified that the baby, later named Kerra, was born alive and took a breath before she died. Kostur had also said she heard the baby cry.
Kostur faces a minimum 10 years in prison when she is sentenced July 25.
Prosecutors say Kostur was seven months pregnant when she prematurely gave birth Jan. 21, 2007, at a home she shared with her mother and grandfather.
