ACLU Sues Over Use Of Tax Records In Id-Theft Case
The American Civil Liberties Union has filed a lawsuit claiming the Weld County District Attorney and Sheriff illegally seized records from an income tax service as part of an identity theft investigation.

Greeley, Colo. (AP) The American Civil Liberties Union has filed a lawsuit claiming the Weld County District Attorney and Sheriff illegally seized records from an income tax service as part of an identity theft investigation.

The lawsuit asks a judge to order that the records be returned and any copies be destroyed.

The suit was filed Monday in Weld County District court in Greeley.

District attorney Ken Buck said Tuesday he doesn’t believe deputies acted improperly. Sheriff’s spokeswoman Margie Martinez referred questions to the sheriff, who did not immediately return an after-hours call seeking comment.

A judge blocked Buck from filing more charges in the case because confidential tax information was included in public court files.

Buck has since taken additional cases to a grand jury, which he says has returned five or 10 more indictments.
