A lawsuit filed against Mesa County Valley School District 51 was dismissed by a federal judge.
In May 2005, Grand Junction High School student, Jessica Weiker, and her parents, Deb and Rick, sued the district after Jessica failed to make the varsity volleyball team at tryouts.
The suit claimed that the district did not provide her with an equal athletic opportunity for female athletes in compliance with Title Nine under the Educational Amendments of 1972. Other constitutional civil rights claims were also filed.
The judge ruled that the Wiekers' burden of proving ineffective accommodation was insufficient, and that the school district was entitled to judgment in its favor of Weikers' other claims.
