RIFLE, Colo. (KKCO) - A first degree murder trial in of Rifle is moving forward.
A Garfield County Judge has set a trial date for 21-year-old Heath Johnston.
Johnston is accused of shooting and killing his brother Samuel at their Rifle home last December. He has pleaded not guilty by reason of insanity.
Police say Johnston told them his brother was unhappy and asked to be killed.
The Garfield County District Attorney says he doesn't plan to seek the death penalty.
Johnston's bond is set at $ 2 million.
