GRAND JUNCTION, Colo. (KKCO) - Bond has been set at $1 million for the Grand Junction man accused of shooting and killing another man Sunday night. Monday, court documents are shedding new light on what led up to the tragic events on Texas Avenue.
Thirty-one-year-old Robert McCleland appeared in court Monday afternoon via video screen, where he was advised of the charges he faces, the most serious is first degree murder.
McCleland's emotional father briefly spoke to the judge calling the incident a tragedy, and saying his son is a good kid, apart from his drinking problems.
11 News has learned the name of the victim in this case but has chosen not to release it until authorities have been able to notify all of his family members.
According to an arrest affidavit obtained by 11 News Monday, a male neighbor of McCleland's heard him and a woman arguing outside their Texas Avenue home just before 9 p.m. Sunday night. That neighbor called police, then went over to the house to try to calm McCleland down.
During an interview with police, McCleland said the neighbor was being confrontational and he told him to leave several times. When the man wouldn't, McCleland says he walked inside his house and got his Glock .40 pistol.
He told investigators he then fired one shot at the ground near the man's feet, then fired a second shot that hit the neighbor's foot. McCleland claims the neighbor still would not leave and that's when he shot him in the head.
Police say when they arrived on scene, McCleland was still standing on his porch with the pistol in his hand. Officers ordered him at gunpoint to drop it and after he did, they took him into custody.
The victim was rushed to the hospital where he later died.
According to the affidavit, McCleland refused to take a breathalyzer test while he was being interrogated, but told investigators he'd had four beers that night.
He is due back in court next week.
Officials say an autopsy on the victim has been scheduled for Tuesday.
