GRAND JUNCTION, Colo. -- (KKCO) A former area law enforcement officer accused of sexually assaulting a young child over a period of years will now be allowed to leave the state to seek employment.
According to our partners at the Montrose Daily Press, 44 year old Kevin Cundiff appeared in Montrose County Court Thursday, where he waived his right to a preliminary hearing concerning probable cause in his case.
His defense attorney also said during the hearing that it's difficult for Cundiff to get a job locally, and asked if he could be allowed to leave the state for work, since he doesn't appear to be a flight risk.
The court approved the request, and he now has an arraignment date set for October 21st in district court since he waived his preliminary hearing rights.
Cundiff is a former sheriff's deputy and police officer in Ouray and Delta counties.
He's free on bond after being arrested in August on sexual assault charges.
