GRAND JUNCTION, Colo. -- The grandparents of two boys who died of hyperthermia have been granted sole custody of their bodies.
Robert and Diane Mathena have been fighting for the right to bury their grandsons Tyler and William Jensen since the boys died in November and December.
However, their mother, Heather Jensen, was initially given custody of their bodies, so the Mathenas filed an injunction on Dec. 6 to put a hold on the case.
On Feb. 4, a judge granted Diane Mathena sole responsibility to determine how the remains are handled. The Mathenas said this has been a long battle they've been fighting and finally get a piece of closure for their son, Eric, who died in a car crash in October.
"He loved those kids more than life itself, that's why we've fought so hard for him," Robert said.
The decision to grant Diane the rights to bury her grandsons comes the day after Heather was extradited back to the Mesa County Jail on charges of child abuse resulting in death, criminally negligent homicide and false reporting to authorities.
Monday, Heather also made her first Mesa County court appearance--via video-- for the criminal charges. The judge said her bond will be held at $150,000, and her next appearance is scheduled for Feb. 7.
An arrest affidavit reveals that on Nov. 27, 2012, Tyler and William were left in an over-heated 4-Runner for 65 minutes. They both suffered hyperthermia, and William died on site. Tyler died on Dec. 3 at a Denver hospital..
