New trial date set for CSP troopers involved in Jason Kemp shooting

GRAND JUNCTION, Colo. (KKCO) - According to Mesa County District Attorney Pete Hautzinger, defense lawyers for Corporal Kirk Firko and Trooper Ivan Lawyer said they need more time to present their cases.

A new trial date has been set for the first two weeks of April, 2012.

On July 20, 2010, troopers responded to the scene of what was first reported as a hit-and-run on Glade Park Road.

Firko and Lawyer are accused of kicking in Kemp's door at a nearby house while investigating that accident.

Kemp was unarmed, but Lawyer told a Grand Jury he saw a flash of light and thought he had been shot so he fired at Kemp, killing him.

    The Fourth amendment: The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

    All I have to say is WOW.. Some of the comments on here are insane.. It's obvious that the people saying the officers were in the wrong have never served in the military or for a law enforcement agency. Everyone is so quick to judge because of a media headline.. There is a reason you are on here posting a comment about two officers that swore to protect you instead of putting your life on the line.. I also agree with the comment about needing to learn your amendments this just goes to show how unintelligent you truly are.. It's safe to say that police officers are human even though several comments on here try to reflect a different story and they are allowed the same time in the court process as everyone else.. Now only if they would get a slap on the wrist like everyone else who has been in the media lately for various crimes oh wait that can't happen because they're held to higher standard by everyone. I would wish the officers in the case luck with their endeavors through court and my prayers will be with you.

    Jr - you might ought to read the Constitution and find out what the various amendments are before you show your ignorance. Also, have you ever had somebody shoot at you. I have, in Vietnam, and the adrenaline is so high normally that you dn't hear the "report". Personally, I would like to thank those troopers for their years of service to the people. Those of you who don't like police, don't call the police when you're getinng beat up or robbed. Simple answer....1

    Officers that blow through the 5th amendment, and attack someone in their home deserve to go to jail. Drinking and driving is bad, but It doesn't give officers a reason to forcefully enter his home without a warrant. And the officer said he Saw a flash of light, where was the report ("bang") of the weapon that he thought was fired? Some officers just get to excited, and complacent, and this is the result.

    This was obviously an accidental shooting. The only reason they were charged is because of the deviant liberal corrupt local government. Political correct liberals are destroying this country. Remember, when the food runs out, the liberals will be the first ones eaten.

    Guarantee that this would have already been prosecuted if the guy had shot the cop that kicked in his door, and he would be in prison. Nope, wasn't there but it is not uncommon to hear that officers actually do make mistakes and are not perfect as portrayed on tv.

    Hey guess who didn't get shot by the cops that day? All the people who CHOSE not to drive drunk, crash their vehicle, flee the scene of the crash, resist arrest and disobey a lawful order from law enforcement officers.

    Typical responses from most people who commented. You were not at the scene and you have no idea what was going on. It is very easy to monday morning quarterback any situation. Regardless of how this turns out, it is my hope that those of you who are anti-cop, if you ever need one, they will leave you to fend for yourselves.
