MESA COUNTY, Colo. (KKCO) There was no way anyone would be able to tell that Shawn Payne was armed with a pellet gun and not a real firearm.
That is the conclusion DA Pete Hautzinger came to after reviewing the actions taken in a officer-involved shooting near the Utah border in July.
After reviewing the critical incident response team investigation Hautzinger determined that the actions taken by police were appropriate and justified.
Payne was pursued by members of the GJPD, Mesa County Sheriff's Department, and Colorado State Patrol westbound on I-70 after receiving notice of a warrant out for his arrest for an attempted sexual assault. The vehicle Payne was driving rolled, and Payne exited out of the back window wielding the pellet gun.
