UPDATE: James David Tiner captured in Garfield County

GARFIELD COUNTY, Colo. (KKCO) - The FBI Denver Division would like to thank the media and the public for their assistance in identifying the whereabouts of James David Tiner.

After seeing the publicity given to accused sexual assault suspect James David Tiner, citizens from Garfield County, Colorado, provided tips to law enforcement that lead to his arrest. Late on Friday, December 21, 2012, law enforcement officers from the New Castle Police Department received tips from concerned citizens regarding the possible location of Tiner.

Tiner and his vehicle were identified, after a short pursuit, law enforcement from New Castle Police Department, Garfield County Sheriff’s Office, and FBI apprehended Tiner at approximately 1:30 a.m. on Saturday, December 22, 2012.

Tiner is being held on a no bond warrant in the Garfield County Detention Facility for the Palisade Police Department. No court date has been set in this case.

James David Tiner, 59, is a former music teacher who allegedly took advantage of his 8-year-old student when she came to his Palisade home for lessons.

Investigators say Tiner had at least four sexual encounters with the girl, and when his home was searched, officers discovered videos and photographs of the victim in the nude.

The FBI reports that Tiner also had pictures of other unknown, underage girls. After the investigation was complete, he was charged with sexual assault on a child, sexual assault on a child—pattern of abuse, and sexual assault on a child by on in a position of trust

In April 2012, the Mesa County Court issued a state arrest warrant for Tiner, and in June, the U.S. District Court for Colorado sent out a federal arrest warrant after Tiner was charged with unlawful flight to avoid persecution.

Tiner was captured and is now on custody.
