The District Attorney's office now says a miscommunication led to a delay in a 2 year old vehicular homicide case.

Last week prosecutors and defense attorneys told a Mesa County Judge they couldn't move forward because the Colorado State Patrol lost evidence.

Turns out the evidence custodian was on leave and it just took longer to track down five pieces of evidence for the case.

26 year old Jade Huskey is facing seven charges including vehicular homicide for a February 2006 crash.

The DA's office says a hair sample and blood viles they need for the case are still intact.

The Huskey case will be back on the docket May 1st.
