Tax Issue: Supreme Court Refuses to Rule
The Colorado Supreme Court has refused to issue an immediate ruling on whether a school tax law is constitutional.
The State Department of Education had asked the court to issue a decision this week because local school districts face a December 15th deadline for setting their property tax rates.
The Court denied the request Friday and didn't say when it would rule.
At issue is a 2007 law expected to raise $1.7 Billion for Colorado Schools over the next 11 years by blocking a scheduled decline in property taxes.
Opponents, including Mesa County Commissioners sued, saying the law amounts to a tax increase that should have been approved by voters under Tabor. A District Court Agreed and overturned the law, but supporters appealed to the Supreme Court.
Mesa County Commissioner Janet Rowland says they are going with the District Court's ruling until they hear otherwise.
