Family members of a man who was beat to death Friday night are speaking out; 11 News Reporter Kieran Wilson spoke to them Monday and has their story.

Theresa Baley and Todd Pierce had been together for 28 years, but recently his drinking has gotten in the way of their common law marriage and he’s been living on the streets for the past few months. This didn’t stop Baley from checking on him daily, she says "I didn't want to find him dead anywhere, that always went through my mind but that day he didn't call me and I knew something was wrong."

Last Friday Baley’s worst nightmare came true, Pierce was found lying face down in the snow beaten to death. Police arrested Michael Bateman Saturday and he is being charged with second degree murder in the death of Todd Pierce. According to Bateman’s arrest affidavit he started beating pierce over starting a fire to keep warm, a reason that Pierce’s family is having a tough time coping with. His Step-daughter Jody Davis says, "people should have compassion especially this time of year, he just wanted to stay warm just like everybody else."

The family says that Pierce was trying hard to quit drinking, he was looking for a job and a home. Baley says pierce was making real progress and she was getting ready to take him back, but now it's too late. Baley says the last time she spoke to Pierce he said "after Christmas he was going to try and get a place because he wanted his family back together." Now his family is spending their Christmas planning a funeral.

The family is asking for the communities help with Pierce's funeral. Donations are being accepted in Todd Pierces name at Wells Fargo on North Avenue.
