Blagg re-trial motions hearing continues

GRAND JUNCTION, Colo. (KKCO) - The motions hearing for a re-trial for convicted murderer Michael Blagg continues Wednesday.

So far, a witness for the defense has testified and showed the court where exactly where juror Marilyn Charleswoth sat during the trial. Blagg's defense says Charlesworth had a vision problem she didn't disclose during the trial where Blagg was convicted of murding his wife Jennifer. The defense says Blagg's trial was unfair.

The defense also tried to enter into evidence nearly 150 DVDs of the original recording of the case, to which Judge Bottger said, "There is not a chance in the world that I am going to watch exhibit BB."

The prosecution has called an opthamologist who had seen Charlesworth over the years. He called her vision "good" and "functional," even commenting that he wouldn't be surprised if there were other jurors with "even worse vision" than hers.
