Jury chosen in Jensen trial and opening statements completed

GRAND JUNCTION, Colo. The jury has been chosen in Heather Jensen's trial. Both sides settled on a jury of 10 women and 5 men, which will make 12 jurors and 3 alternates.

Opening statements began and the prosecution kicked it off going through the background of the night of the incident while showing picture of Jensen's young sons Tyler and William.

The prosecution said Jensen spent the afternoon having sex with a man after child locking her kids in the car, which the prosecution called a death sentence.

The defense then took to the podium and asked the jury not to judge her based on her decisions in leaving the children unattended and brought up that she has an IQ of 76 and is borderline developmentally disabled. They also used her young age and losing her husband as the reason for her choices.

Jensen was visibly upset and crying during the opening statements.

Before those opening statements, questioning to choose the best jury continued, which was more in-depth than yesterday.

The prosecution questioned a pool of 31 jurors and assistant Disitrct Attorney Rich Tuttle focused on their sympathies as well as whether or not they work with children in their jobs and if they had children of their own.

The defense questioned the same folks, dismissing 16 of them after 6 hours.

During his questioning, Tuttle asked Judge Valerie Robison if he could read the jurors the definition of criminal negligence. She granted the request as jurors yesterday said they would have had a bias in the case without even knowing the true definition of what Jensen is being charged with.

The definition is: A gross deviation from the standard of care expected of a reasonable person that manifests in a failure to protect others from risk making one criminally liable as a result of their conduct.

Both parts of that have to be proven beyond a reasonable doubt to get a guilty verdict.

Day three of the trial continues on Thursday morning.
