MESA COUNTY, Colo. (KKCO) – The mother and her boyfriend arrested in the case of an abused four-year-old boy have a history of abuse.

Documents obtained by KKCO 11 News reveal that Ashleigh Wallace, the mother of four-year-old Elijah Wallace, has seen violence from her boyfriend Jessie Martinez before.

On Jan. 14, 2009, a Grand Junction Police officer responded to the emergency room to investigate a domestic violence case, according to an arrest affidavit.

There, he found Ashleigh covered from head to toe with bruises, a scrape above her eye, and a bite mark above her armpit.

She said the night before, she and Martinez had been drinking whiskey when she confronted him about sexting another person. Martinez became upset, and Ashleigh says he started punching her.

He grabbed her hair and threw her head into the counter top, calling her derogatory names, she told the officer.

Ashleigh called her ex-boyfriend for help, and he picked her and her son up to take them home.

The next day, the affidavit says Martinez visited Ashleigh’s home to talk. She told him he had no right to hit her, which angered him. Martinez hit her again and bit her twice. Between the two instances, Ashleigh says she was hit between 50 and 100 times.

Nine days after Ashleigh’s trip to the hospital, Martinez was arrested for assault. When he appeared in court, he pleaded guilty to one charge of third-degree assault and was sentenced to one year in jail.

Colorado Bureau of Investigation documents show that between 2001 and 2013, Martinez was arrested a total of 18 times on a number of charges, including assault, larceny, escape and more.

According to a CBI background check, Ashleigh has seen her fair share of court time as well.

In 2010, Montrose Police booked Wallace into its jail on multiple charges of domestic violence and misdemeanor child abuse. One charge of assault- menacing was deferred, while the rest were dismissed by the district attorney.

Wallace was arrested six times between 2009 and 2012 for third degree assault, property damage, obstructing government operations, and more. The most recent arrest, in March 2012, was for driving under the influence of alcohol.
