Pot legality in rental properties

GRAND JUNCTION, Colo. (KKCO) With the new Colorado marijuana laws in effect allowing the recreational growth and use of pot, many landlords and property owners have questions as to what is and isn't allowed.

At a free clinic yesterday, the Pro Bono Project of Mesa County attempted to answer some of the most common questions people have.

"You don't have a right, you don't have a constitutional right to smoke and that's why you can prohibit it, it's just legal," says Attorney Annie Murphey. "Just like smoking, you can treat it like tobacco."

For a landlord to prohibit the use of marijuana in any way on property they own, they must first ensure it expressly prohibited in the lease.

Otherwise, a tenant can't be evicted for using pot, since it is technically not a crime.
