Jensens' grandparents on "road to recovery"

GRAND JUNCTION, Colo. (KKCO) -- For the first time in seven weeks, the grandparents of William and Tyler Jensen are breathing a sigh of relief.

"It's been 52 weeks of tears and depression, just no hope for the future, and now we get to bury our grandsons and get on the road to recovery," said Robert Mathena, the boys' grandpa.

The Mathenas' lawyer, Greg Leavitt, attorney at Harshman and McBee in Grand Junction, said Heather Jensen's arrest makes it likely the Mathenas will get the rights to bury their grandsons.

"Because Heather Jensen was charged with multiple charges including criminally negligent homicide, [Title 15 under Colorado Statutes] removes her rights to make a decision while handling the last remains while she is charged," Leavitt said.

Leavitt said he is also attempting to have the Mathenas appointed as the personal representatives of Tyler and William's estate, which would allow them to make decision on their behalf.

"You never know how it's going to turn out," Leavitt said. "We have some relief but really in this case, there's not a good outcome for anybody. William and Tyler are deceased and we can't change that. It's still sad."

The Mathenas believe burying William and Tyler is the "right thing to do."

"They're human beings, they deserve respect and now we have a place to go visit them," Diane Mathena said.

Leavitt said the hearing to officially grant the Mathenas the right to bury their grandsons likely will not be until the end of January.
