Colorado State Patrol confirmed that 8-year-old Josiah McCracken was not wearing a seatbelt when the minivan he was riding in was hit by a dump truck.
Authorities say on Thursday, the van carrying McCracken and his family was stopped at a traffic light in Olathe when a dump truck rear ended them. The force of the crash pushed the van through the intersection and into a utility pole.
McCracken's mother, and his two sisters were wearing their seatbelts, and were taken to Montrose Memorial Hospital with minor injuries.
McCracken was also taken to the hospital where he later died.
The driver of that truck, 43-year-old Ronald Wilborn was cited for reckless driving resulting in death.
