Colorado jurors now have the option of submiting their own questions to witnesses in criminal trials, a decsion that leaves many defense attorneys unhappy. The decsion by the Colorado Supreme Court came Monday by a 5-1 vote.
The court says this practice does not automatically harm the defendents right to a fair trial. The new method of questioning has been used throughout the state, and defense lawyers have been working to overturn convictions in which jurors submited questions, as well as bar jury questioning all together.
Monday, the justices even turned back appeals by two people who were convicted in trials that allowed jurors to submit questions.
