Vail (AP) A Colorado ski resort is doing something unusual: countersuing a skier who filed a lawsuit over an injury. It's the first time Vail Resorts countersued a skier like that, the Denver Post reports. Vail argues local real estate agent Julia Parsons gave up her right to sue by buying a season pass.
Parsons cut her knee hitting a metal bracket jutting out from a ski bridge. Her lawsuit accuses the resort of negligence. Her attorney, Joseph Bloch, says other skiers who buy day passes don't have to give up their right to sue.
In court filings, Vail is accusing Parsons of skiing out of
control before hitting the ski bridge.
Colorado law requires skiers to remain in control. Vail says it's willing to give up its suit if Parsons withdraws her's.
Trial is set for March.
