Opening Arguments Delivered in Moore Case

Opening arguments in the first degree murder case against Brandon Moore were delivered Wednesday afternoon.

Moore is accused of beating his stepson, 2-year-old Logan Acord, to death.

The prosecution told jurors it plans to show that because of the severity of the injuries Logan suffered there is no way it could have been an accident.

The defense told jurors Moore loved Logan and there was no motive for him to do anything to hurt the baby. The defense said Moore is guilty of failing to act as a parent should have and guilty of not calling 911.

According to court documents, Moore told investigators that Logan had fallen and hit his head in the bath tub and slipped into a lifeless state so he slapped and bit the baby to wake him up.

District Attorney Pete Hautzinger has said that the evidence points elsewhere and that this is the worst child abuse case he's ever seen.

According to an arrest affidavit, Logan had a bruise the size of an orange on his thigh, dark bruising all over his body and swelling and hemorrhaging on the brain when he died at St. Mary's Hospital.

The District Attorney's Office is not seeking the death penalty in this case. If convicted on first degree murder Moore faces life in prison without parole.

The defense wants Moore to face a reduced charge of criminally negligent homicide which carries a sentence of up to six years.

Moore is out on bond. His trial is expected to last two weeks. The prosecution will begin presenting evidence on Thursday.

    I think he should've gotten the death penalty. But thats just ones oppinion. Brandon Moore is evil and I hope he is gettin' his ass kicked every day in prision.
