Jury Deliberates In Wieberg Trial

The first degree murder case against a Grand Junction man is now in the hands of a jury, this after the defense team for 22-year-old Christopher Wieberg never called a witness, including the defendant himself.

Along with jury instructions given by Judge Flynn, the prosecution once again ran over their case, including the two dozen witnesses called and dozens of pieces of evidence admitted in the case.

Wieberg's defense attorney argued the district attorney has not proven beyond a reasonable doubt that the defendant premeditated the murder of 28-year-old Thomas Martinez, which happened in a Fruitvale apartment in October 2005.

He also said that the shooting was in fact accidental.

The jury will be back in deliberation early Wednesday morning.
