GRAND JUNCTION, Colo. (KKCO) – The state will retain custody of the boy who suffered liver and kidney damage in an incident at Powderhorn Tuesday night.

Four-year-old Tyler Jensen has been in state custody since he and his brother, William, were left in their mother’s 4Runner Tuesday. William died in the incident. The mother, Heather, said on her Facebook she believes the boys were poisoned by carbon monoxide.

Now, some of Tyler’s family want him to live with his uncle, Johnny Jensen, according to Tyler’s step-grandfather, Robert Mathena. However, during a custody meeting this morning, it was determined that Tyler would remain with the state.

“It’s best for now, until we see what happens to Tyler,” said Mathena.

The four year old is in Children’s Hospital in Denver, suffering from severe kidney and liver damage. Doctors have given him a slim chance of surviving because he is too weak for any transplants.

The Mesa County Sheriff’s Office has been investigating the incident, and Heather Benjamin—the agency’s spokesperson-- says the documents relating to this incident have been sealed by the district attorney, so there’s little they can release at this point.

Corrections: It was previously reported that David, not Johnny, would be asking for custody, and that Tyler had zero chance of surviving. The doctors have revised his status to a "slim chance" of survival.
