GRAND JUNCTION, Colo. (KKCO) - Newly elected at-large councilman Rick Brainard remains in jail Sunday night following his Saturday morning arrest.

Brainard was taken into custody after a physical altercation with his live-in girlfriend. He's facing charges of third degree assault and harassment.

Brainard was elected to replace current councilman and mayor, Bill Pitts. Pitts told us on Sunday this is an unusual situation, and city council has never been faced with an issue like this before.

Pitts and the other council members were notified of Brainard's arrest in an email from the city manager.

He says city council was not scheduled to meet this week, but that could now change.

We'll continue to keep you updated on this developing story.

All i can say now is that this guy should resign or has he been swore in yet? Regardless this is not the kind of person who needs to be in politics but wait yes he is as he would fit in fine with the rest of the politicians in the USA! i hope his girlfriend does press charges and has him prosecuted to full extent of the law.
