LONGMONT, Colo. (AP) -- An arraignment scheduled for a man charged in a wreck that caused a pregnant woman to lose her fetus has been delayed because the defendant has been hospitalized in critical condition.
The Longmont Times-Call says 52-year-old Gary Sheats was scheduled to appear in court Friday, but the hearing was reset for Nov. 30 at his attorney's request. It's unclear why Sheats is hospitalized, but his father previously told the newspaper his son has cancer and has only months to live.
Prosecutors say Sheats' blood-alcohol level after the July 5 crash in Longmont was more than three times the legal limit for driving.
Among other charges, he faces two counts of vehicular assault. Sheats wasn't charged with vehicular homicide because under Colorado law a fetus is considered a part of the mother until born.
