Judge: Too early to rule on Holmes case reporter

CENTENNIAL, Colo. (AP) -- The judge in the Colorado theater shootings case says it's too early to decide whether a Fox News reporter should have to reveal her confidential sources or risk going to jail.

But Monday's ruling says New York-based reporter Jana Winter still has to appear at a hearing in a Colorado courtroom on Wednesday.

Winter cited anonymous law enforcement officials saying Holmes sent a psychiatrist a notebook containing drawings that foreshadowed the deadly July attack.

Holmes' lawyers want to know who the law enforcement officials are. Among other things, the defense argues the leak could weaken the credibility of those officials if they are called to testify in a trial.

The judge ruled the credibility issue won't come up unless the notebook is admitted as evidence, and that hasn't been determined.
