GRAND JUNCTION, Colo. (KKCO) -- A local mother who claimed she was being evicted because her son stole some shoes is now in new trouble with the law.

Last week, Grand Junction police say they went to the apartment of 31-year-old Tanya Abbey at 26th Street and Belford Avenue after receiving reports that her younger children roaming around the complex in pajamas.

Police say they found the door to her apartment open and that there is an eviction notice on her door now.

They found Abbey and a man asleep inside, woke up the pair, and said they suspected she and the male had used drugs.

Officers say they found needles, a bag of marijuana within reach of the children and other items.

The children were given to their grandmother after Child Protective Services was called, and Abbey was given a summons. She's due in court next month.

In December, Abbey gained national attention when she claimed she was about to be evicted because her son had stolen a pair of shoes. Housing resource officials said that was not the case and they wouldn't evict anyone before or during the holidays.

They also said a family would never be evicted because of a shoplifting offense committed by a minor.
