DENVER (AP) – Colorado’s Secretary of State is under fire for trying to weigh in on a court case involving his former client.

Republican Scott Gessler asked a state Appeals Court last week for permission to file a brief in favor of Clear the Bench, a right-leaning group Gessler used to represent as an elections lawyer.

The request prompted an objection from Colorado Ethics Watch, a progressive group that says Gessler is wrongly using state time. A spokesman for Gessler says he’s standing up for the matter at hand, which is whether Clear the Bench should have relied on advice from the Secretary of State’s Office.

The Colorado Court of Appeals is considering whether to accept Gessler’s brief in the dispute over whether the group should have registered as a political committee.
