Emergency cell phone access for police considered

DENVER (AP) -- Cell phones may be subject to warrantless review by law enforcement in times of emergency under a bill up for review in Colorado Tuesday.

The bill would allow authorities to get access to communications or call location information without a court order. The authorities would have to show probable cause to believe an emergency situation exists. The authorities would have to show that the time required to obtain a search warrant could put a person at risk of death or serious bodily injury.

Warrantless phone searches are a major new privacy battle. The proposal has backers from both parties, and will likely raise opposition from both parties.
