Denver (AP) Prosecutors and defense attorneys will present opening statements Friday in the case of a Louisville man accused of fatally injuring his 11-week-old son.
It took four days to pick the panel of six men and 10 women who will hear the case involving 29-year-old Alex Midyette of Louisville.
Midyette is accused of fatal child abuse in the March 2006 death of his son, Jason. Doctors say the infant had more than 20 broken bones and a skull fracture.
Midyette’s trial had been postponed three times and moved twice from Boulder before starting Monday in Denver District Court. Midyette claims his son wasn’t abused but suffered from a rare medical problem.
Midyette’s wife, Molly Midyette, was convicted of child abuse in 2007 and was sentenced to 16 years in prison. Prosecutors say she didn’t seek help for her son in time.
