A man convicted in the death of his 5-week-old baby in Grand Junction five years ago will spend more than 40 years in prison.

Dartanin Mitchell was charged with child abuse resulting in death of his 5-week-old son, Lucius Lee Mitchell, who died in 2011 in Grand Junction. He was also charged with child abuse resulting in serious bodily injury.

He was already in jail on trespassing, burglary and theft charges, dating back to 2011 out of Denver, according to court documents.

At the time he was arrested in 2011, he was only considered a person of interest in his son's death, but that charge would not come until a year later.

He later escaped from custody while being transported to Grand Junction, and he was later caught.
